ART COMMISSION TERMS OF SERVICE
By commissioning me, you confirm that you have read, understood, and agreed to all of the terms listed below.
1. Age Requirement
By commissioning me, you confirm and agree that you are 18 years of age or older.
2. Character Ownership
- My original characters (OCs) are my property.
- Adoptables, characters, and other elements belonging to third parties remain the property of their respective owners.
- The commissioner is responsible for ensuring that they have the necessary rights or permission to commission artwork featuring characters or elements that do not belong to them.
3. Commissioner Responsibility
The commissioner is responsible for the characters, references, concepts, and context provided for the artwork.
Even when artistic freedom is allowed, I will only draw what has been requested or what has been explicitly permitted by the commissioner.
4. Artistic Style
By commissioning me, you agree to and accept my art style and artistic process.
My fully rendered artwork includes shading, lighting, effects, and other rendering techniques that may result in changes to the original colors of your character.
Therefore, slight differences in color, tone, saturation, contrast, or lighting compared to the provided references are not considered mistakes.
5. Unused Sketches and Ideas
Sketches, drafts, concepts, ideas, and discarded versions created during the commission process remain under my authorship.
I reserve the right to reuse, modify, or incorporate discarded sketches and ideas into future artwork at my discretion.
6. Posting and Credit
You are free to post your commissioned artwork on any platform you wish, provided that:
- My signature remains visible and is not removed, hidden, or altered.
- Proper credit is given to me as the artist.
- The artwork is not presented as being created by the commissioner.
7. Editing and Modification
No one, including the commissioner, is authorized to edit, modify, redraw, or otherwise alter my artwork without my prior permission.
This includes, but is not limited to:
- Changing the colors;
- Applying filters that significantly alter the artwork;
- Removing or altering my signature;
- Adding or removing elements;
- Cropping the artwork in a way that removes important information or credits;
- Having another person edit or modify the artwork.
8. NFTs and Artificial Intelligence
It is strictly prohibited to use any part of my artwork, whether commissioned or personal, for:
- Creating, selling, or promoting NFTs (Non-Fungible Tokens);
- Training or assisting in the training of Artificial Intelligence models;
- Generating derivative images through AI tools;
- Using my artwork as input, reference material, or source material for AI image generators for the purpose of creating derivative content.
This restriction applies to the entire artwork as well as any portion, crop, or element taken from it.
9. Commercial Use
The commissioner may not profit from my artwork or claim the artwork as their own.
Commercial use is not included in the standard commission price.
This includes, but is not limited to:
- Selling the artwork or reproductions of it;
- Using the artwork on commercial products;
- Using the artwork for advertising or commercial promotion;
- Incorporating the artwork into products, games, books, merchandise, or other materials intended for sale;
- Claiming authorship of the artwork.
If you wish to use the artwork commercially, commercial rights, terms, and additional fees must be negotiated and agreed upon before I begin the commission.
10. Artist's Rights and Copyright
The artist retains the copyright and authorship of the artwork created, regardless of who owns the character or other elements depicted in the artwork.
Commissioning artwork does not automatically transfer copyright or ownership of the artwork to the commissioner.
The commissioner receives only the usage rights explicitly agreed upon between both parties.
I retain the right to reproduce, display, distribute, and use the artwork for portfolio purposes, self-promotion, advertising my services, and other artistic promotional purposes, provided that this does not imply ownership of characters belonging to the commissioner or third parties.
11. Portfolio and Gallery Use
By commissioning me, you give me permission to display the finished artwork as an example of my work in my:
- Portfolio;
- Online galleries;
- Social media;
- Commission pages;
- Websites;
- Promotional materials.
I reserve the right to decide which artwork, images, or stages of the process I use in my galleries and promotional materials.
If you do not want your commission to be publicly displayed, you must request a Privacy Option before the commission begins.
12. Right to Refuse a Commission
I reserve the right to refuse or decline any commission request at any time and for any reason, without being required to provide an explanation.
13. Privacy Fee
If you do not want your commissioned artwork to be posted in my galleries, portfolio, social media, or other public promotional materials, you may request a Privacy Option.
The Privacy Fee is an additional 60% of the total commission price.
The Privacy Option must be requested before the commission begins.
Payment of the Privacy Fee does not transfer ownership or copyright of the artwork to the commissioner. I remain the author and copyright holder of the artwork.
The purpose of the Privacy Fee is solely to prevent the commissioned artwork from being publicly displayed by the artist in galleries, portfolios, social media, or other promotional materials.
All other terms of these Terms of Service remain applicable.
14. Payment
- All commission prices are listed in USD and/or BRL.
- For USD payments, I only accept payment through a Wise invoice.
- For BRL payments, payment will be made via PIX.
- Payment will only be requested when it is the commissioner's turn in the queue.
- You do not need to pay anything to reserve a slot or remain in the commission queue.
- Payment plans may be negotiated between the commissioner and the artist.
- Regardless of the payment method, I will only begin working on the commission after the full payment has been received, unless another arrangement has been agreed upon beforehand.
Being placed in the commission queue represents only the commissioner's position in the order of service and does not constitute an advance payment or payment obligation.
15. Refund Policy
- No refunds will be issued once the commission has been completed.
- A full refund will only be available if:
The commission has not yet been started; or The artist cancels the commission for any reason.
Cancellation by the Artist
I reserve the right to cancel a commission at any point during the creative process if the request, content, or circumstances surrounding the commission make me uncomfortable or no longer align with my working conditions.
If I cancel a commission during the creative process:
- The commissioner may choose to submit a new request, without being charged for the work already completed on the cancelled commission.
- The new request will be treated as a new direction for the commission and will follow the terms previously agreed upon.
- If the commissioner does not wish to submit a new request, a full refund of the amount paid will be issued.
Cancellation of a commission by the artist does not grant the commissioner permission to use, reproduce, edit, distribute, or otherwise exploit any sketches, drafts, unfinished versions, or other materials created during the cancelled commission, unless expressly authorized by the artist.
16. Agreement
By commissioning me, you confirm that you:
- Are 18 years of age or older;
- Have read and understood these Terms of Service;
- Agree to all of the conditions stated above;
- Accept my artistic style and creative process;
- Accept the rules regarding artwork usage, copyright, privacy, commercial use, NFTs, and AI;
- Understand that commissioning artwork does not automatically transfer copyright or ownership of the artwork to you.
By submitting a commission request and/or making payment, you acknowledge and agree to all of these Terms of Service.
